Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

Eligibility: The Sweepstakes is open and offered only to legal residents of the 50 United States, District of Columbia, and Puerto Rico who have reached the age of majority in their state or territory of residence at the time of entry.  In addition, participants must subscribe to ELECTRICAL CONTRACTOR magazine (print) and/or receive one or more of the newsletters by e-mail. The Sweepstakes is not open to the general public. Employees, officers, and directors of the Sponsor, its affiliated companies, subsidiaries, franchisees, distributors, dealers, advertising and promotion agencies, and (iii) any and all other entities directly associated with this Sweepstakes (collectively, the “Released Parties”), and the immediate family members and members of the same household of any of the foregoing are not eligible to participate in the Sweepstakes.  By entry into the Sweepstakes, entrant consents to these Official Rules. 

Sponsor/Administrator: The Sweepstakes is sponsored by ELECTRICAL CONTRACTOR, 1201 Pennsylvania Ave. NW Suite 1200, Washington, D.C. 20004 (the “Sponsor”) and is administered by American Sweepstakes & Promotion Co, Inc., 300 State St. Suite 402 Rochester, NY 14614 (the “Administrator”).

How to Enter: Eligible Entrants can enter the Sweepstakes during two (2) separate periods. Databases will not carry over. The Sweepstakes will run on in accordance with the following times and dates (“Sweepstakes Periods”):

• Period 1: Begins at 12:01 a.m., Eastern Time (“ET”), September 1, 2024 and ends at 11:59 p.m., ET on September 30, 2024.
• Period 2: Begins at 12:01 a.m., Eastern Time (“ET”) October 1, 2024 and ends at 11:59 p.m., ET on October 31, 2024.

   

  Complete the Survey: Eligible entrants may enter the Sweepstakes by clicking on the link that was indicated in the email. Entrants must complete the on-line survey and hit Submit Survey.  In addition, the following information must be entered on-line: email address of entrant where they would like to receive the e-Gift card, should they win. All entries must be received by 11:59 pm ET October 31, 2024.

   

  Limit one (1) entry per person per survey allowed. Released Parties are not responsible for illegible, damaged, lost, late, misdirected entries. Released Parties reserve the right to disqualify any person or address suspected of submitting multiple or fraudulent entries or of tampering with the entry process. All entries become the property of the Released Parties and will not be returned.

   

  Internet Limitations of Liability: Sponsor reserves the right, in its sole discretion, to cancel, terminate, suspend and/or modify the Sweepstakes, or any part of it, at any time, without notice, and award prizes using all non-suspect eligible entries received as of the date of such termination/suspension date, if any infection, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond Sponsor’s control, affects the integrity or proper conduct of the Sweepstakes.  Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process (if applicable) or the operation of the Sweepstakes or who is otherwise determined to be acting in violation of these Official Rules or any other promotion or in a disruptive manner. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, and the entries. Sponsor is not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, or misdirected entries; theft, destruction or unauthorized access to, or alteration of, entries; failures or malfunctions of phones, phone lines or telephone or data transmission systems; interrupted or unavailable network, server or other connections; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or any technical problem, including but not limited to any injury or damage to any person’s computer related to or resulting from Sweepstakes participation; typographical, printing or other errors or omissions in these Official Rules, in any Sweepstakes-related advertisements or other materials, or other problems or errors of any kind whether computer, network, mechanical, human, electronic, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, in the processing of entries, in the selection or announcement of winners or in the awarding of prizes. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

   

  Sponsor is not responsible for any damage to an entrant’s computer, equipment, or system which is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the Sweepstakes.  Sponsor also is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error, which may occur in the processing of the entries in the Sweepstakes.    CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding the identity of an individual who actually submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account.  "Authorized account holder" is defined as the natural person who is assigned to an email account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner may be required to show proof of being the authorized account holder.

   

  EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER.  SECTION 1542 READS AS FOLLOWS:

   

  “CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

  Drawing and Notification: Prize Winners will be selected from among all eligible entries received (in accordance with these Official Rules) during the applicable period, in random drawings on or about October 10, 2024 and November 10, 2024 by the American Sweepstakes & Promotion Co., (the “Sweepstakes Administrator”), an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. Winners will be notified by email.

   

  Prizes: Three (3) Prize Winners per month will each receive an Amazon $65 e-Gift Card. Total prize pool ARV (Average Retail Value) is $195. If the prize notification is returned as unclaimed or undeliverable to the potential winner, or if a potential Monthly Prize Winner cannot be reached within three (3) business days from the first notification attempt, or if a potential Monthly Prize Winner fails to return requested email within the specified time period, or if potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate winner may be selected for the prize at issue.

   

  Prize Conditions: By accepting any prize, the prize winner agrees to release the Sponsor, the Released Parties, and prize suppliers from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded. No substitution or transfer of prize or election of cash in lieu of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value if the prize (or any component thereof) is not available. Each Prize winner is solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified, and an alternate winner will be selected for the prize at issue.

   

  General: IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES. By participating in the Sweepstakes, entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Sweepstakes or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the prize(s).

   

  Use of Data: Sponsor will be collecting personal data about entrants including e-mail addresses from entry forms in accordance with its Privacy Policy. Please review the Sponsor's Privacy Policy at the following link: http://www.ecmag.com/privacy-policy. By participating in the Sweepstakes and providing your e-mail address, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy. However, notwithstanding the www.ecmag.com privacy policy, the Sponsor will not disclose the identity or contact information of panelists without their written permission.

   

  Disputes:  Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the District of Columbia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the District of Columbia, without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the District of Columbia.
